Tenant Fees Act

Tenant Fees Act 2019

Restricts which fees a letting agent can charge tenants in England. Permitted payments are tightly listed; everything else is banned.

Fitness Act

Homes (Fitness for Human Habitation) Act 2018

Landlords must keep rental properties fit for human habitation throughout the tenancy. Tenants can sue directly for breach.

Right to Rent (Immigration Act 2014/2016)

Verify every adult occupier has the legal right to reside in the UK. List A unlimited, List B time-limited with re-check obligations.

Energy Efficiency / MEES (2015 + proposed C upgrade)

Gas Safety Regulations 1998

Annual Gas Safe inspection per property; tenant must receive a copy of the certificate within 28 days of inspection.

EICR

Electrical Safety Standards 2020

EICR every 5 years for every rental property; tenant must receive the report within 28 days.

Penalty: Up to £30,000 per property

Alarms

Smoke & CO Alarm Regulations 2015 + 2022

Smoke alarm on every storey + CO alarm in every room with a fixed combustion appliance. Tested on day one of every tenancy.

Penalty: Up to £5,000 per property

Deposits

Tenancy Deposit Protection (Housing Act 2004)

Deposit protected in DPS / TDS / MyDeposits within 30 days + prescribed information served on the tenant in the same window.

Penalty: 1-3× deposit awarded to tenant + S21 blocked

NRL

Non-Resident Landlord scheme (HMRC)

Agents collecting rent for landlords with usual place of abode outside the UK must deduct 20% basic-rate tax quarterly and file NRLY annually.

Penalty: Tax + interest + penalties from HMRC

HMO

HMO Licensing (Housing Act 2004)

Mandatory licence for HMOs of 5+ unrelated occupants. Additional/Selective licensing in many local authorities for smaller HMOs.

Penalty: Up to £30,000 per property + rent-repayment orders

GDPR

GDPR / Data Protection Act 2018

Lawful basis for tenant + landlord data, DSR responses within 30 days, breach notification within 72 hours, processor contracts.

RRA 2025

Renters' Rights Act 2025

Section 21 abolished, all assured periodic tenancies, statutory pet right with 28-day deemed consent, rent increase validator, anti-discrimination listing duty.
